Acceptance of Terms

By downloading, installing, or using the FerryFriend app ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

Intellectual Property Rights

The App and all content within it—including but not limited to schedules, predictions, public-agency data displays, code, proprietary models, internal or undocumented APIs, trademarks, images, UI elements, data structures, and database rights—are owned by True Course LLC or its licensors.

You are granted a personal, limited, revocable, non-transferable license to use the App solely for personal, non-commercial purposes.

You may not:

• Copy, modify, reproduce, scrape, extract, save, archive, bulk collect, or reuse any data or content displayed in the App.
• Attempt to reverse engineer, derive source code, or interact with any private, internal, or undocumented API.
• Use App data, content, predictions, or system behavior to train or evaluate software, machine learning models, competing products, or any third-party service.
• Redistribute or use any content for another app, website, business, or software—commercial or otherwise.

Limited sharing functionality included within the App (such as ticket sharing or screenshot sharing) is permitted only in the manner intended by the App.

All images contained within the App are owned by True Course LLC unless otherwise stated. Where public-domain or separately licensed images are used, rights remain with their respective owners and such images may not be reused outside the App.

True Course LLC may block access, revoke licenses, or disable functionality in response to suspected misuse.

Third-Party and Government Data Disclaimer

The App displays publicly available information sourced from transportation agencies including, but not limited to, Washington State Ferries, King County Water Taxi, and Kitsap Transit.

You acknowledge that:

• True Course LLC is not affiliated with or endorsed by any ferry operator or public agency.
• Public-agency data remains the intellectual property of those agencies.
• True Course LLC is not responsible for accuracy, real-time changes, or availability of external data.

Subscription Services

FerryBestFriends Subscription

The App offers optional subscription services ("FerryBestFriends") that provide access to additional features. Subscription benefits may include experimental features, customization options, and ongoing enhancements.

Subscription Tiers and Pricing

Monthly subscription options: $3, $5, $10, $15, $25, and $100 per month
Annual subscription options: $36, $60, $120, $180, and $300 per year

All tiers provide identical functionality. Tier selection affects only placement in any optional public supporter listing.

Trial Period

A 10-day free trial is available for first-time users of version 5.0 of the App or later.

Geographic Restrictions

Subscriptions are available only within the United States.

Auto-Renewal

Subscriptions automatically renew through the Apple App Store or Google Play Store. Subscription management must be handled through the respective store account.

Refund Policy

• Annual subscriptions: Refunds available within 30 days of purchase
• Monthly subscriptions: Refunds available within 14 days of purchase

Supporter Recognition

Subscribers may optionally be displayed publicly within the App. Submitted names:

• Must be appropriate for general audiences.
• Cannot contain political messaging, offensive content, harassment, advertising, or discriminatory language.
• Are subject to approval and may be edited or removed at the discretion of True Course LLC, without notice.

Patreon Migration

Until December 31, 2025, verified Patreon supporters may link previous support by providing their Patreon-associated email address.

Experimental Features Disclaimer

Delay predictions and similar features are experimental and may:

• Be incorrect, unavailable, outdated, or inaccurate
• Change without notice
• Apply only to Washington State Ferries routes

Modifications to the App

True Course LLC may modify, update, or discontinue the App or any features at any time, with or without notice.

User Responsibilities

Device Security

You are responsible for the security of your device and access to the App. Jailbreaking or rooting may prevent the App from functioning correctly.

Data Charges

Some features require internet access. You are responsible for any associated data charges.

Disclaimer of Warranties and Limitation of Liability

The App and all content are provided "AS IS" and "AS AVAILABLE."
True Course LLC makes no guarantees regarding:

• Schedule accuracy
• Data availability
• Prediction reliability
• Feature continuity
• Storage or preservation of tickets, favorites, or settings

True Course LLC is not liable for:

• Travel delays, missed departures, scheduling errors, or operational discrepancies
• Loss of data, tickets, or stored content
• Loss of access due to service interruption, technical issues, or account changes
• Any indirect, punitive, incidental, or consequential damages

Updates to the App

System requirements may change. Continued use may require installing updates. True Course LLC does not guarantee compatibility with all devices or future operating systems.

Upon termination or discontinuation:

• All licenses granted to you expire
• You must delete the App

Prohibited Activities

Users are strictly prohibited from:

1. Using or repurposing App data or content outside the App.
2. Circumventing barriers or attempting unauthorized access to systems or data.
3. Using automated systems (Bots, Scrapers, AI Agents) to access or interact with the App.
4. Interfering with the App’s operation or attempting to degrade service.
5. Using the App in any unlawful or unauthorized manner.

Privacy Policy

Please refer to our Privacy Policy (link to be inserted) for how personal data is collected, stored, and used. The Privacy Policy is incorporated into these Terms.

Indemnification

You agree to indemnify, defend, and hold harmless True Course LLC and its affiliates from any claims or damages arising from misuse of the App or violation of these Terms.

Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration following American Arbitration Association consumer rules. Arbitration shall occur in Seattle, Washington, and the decision shall be final.

Changes to These Terms and Conditions

True Course LLC may revise these Terms at any time. Continued use of the App constitutes acceptance of updated Terms.

Severability

If any provision of these Terms is held invalid, the remaining provisions remain enforceable.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
